US Judge Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. Following his repatriation to the United States to face human smuggling charges, he was held in federal detention.

In her decision, the judge noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.

The court, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
