The Failure of the 28-Clause Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been contained. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its countermove: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of opposing developments captured the bleak nature of the recent timeframe. By day, political struggles are fought: hopeful statements are issued from multiple capitals. Considerable effort is devoted on containing specific proposals. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the key method for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was laid bare. Ukraine is able to track projectile deployments from across the border, a ability afforded by current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to engage hostile cruise missiles flew past – sophisticated military planes delivered to Ukraine by NATO members.

Shortly after, Kyiv's anti-aircraft weapons thundered: multiple launches fired to intercept a hostile projectile. This was a sophisticated defense system at work, presumably provided by Western nations. Every deployment creates sudden vibrations, shaking the windows. The brief panic quickly becomes sober acceptance: maybe the incoming missile won't cause damage this time, protecting urban areas from devastation and another blackout.

Continuous Dangers

Following this, a automatic firearm engaged a unmanned aircraft close by, part of a mobile-fire group – probably Western-made equipment. Regrettably, the projectiles didn't strike the opposing UAV – it maintained course toward its target.

Intermittently, this persisted until dawn. Kyiv awoke to the morning news: seven people killed, damage and utility failures in numerous residences as a result of the evening attack. As customarily, everyone still maintained normal activities – living the war. But those 24 hours illustrated Ukraine's critical military reliance on international aid – a reliance that European nations are evidently unprepared to substitute in the near term.

Failed Diplomacy

The detailed framework from American leadership sparked intense emotion, discussion and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and bilateral conferences.

Every new initiative from American administration adheres to the consistent cycle: a political offensive against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually achieve victory. This trend will, no doubt, persist.

Political Considerations

It is tempting to accuse specific actors of consistently pushing Russian terms. But that does not seem to be the whole story. Washington operates on a assumption familiar among experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The US administration assumes that it is unfeasible to compel Moscow to relinquish the territory that it already controls in Ukraine's occupied territories.

The issue is that while acknowledging this situation, American administration does nothing to deter Moscow, through words or deeds, from believing that the situation will not evolve additionally in its benefit in the months ahead.

Opposing Positions

Therefore, the Kremlin is confident that duration works to their advantage – that Ukraine and its supporters are approaching exhaustion. Their reason to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be multiple initiatives to achieve ceasefire, but they will persist as long as Russia's leader remains highly assured in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still hold out, progressively conceding people and territory but preventing a total frontline collapse until situations evolve in its benefit.

Current Realities

Objectively, there are no real preconditions for a ceasefire. Now, subjective factors are coming into play: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the flag against any initiative Kyiv finds unworkable, so that their attention does not shift toward internal issues. And although their objective will now be much harder after latest incidents, it remains quite doubtful that this will change their overall approach.

These two forces are guiding negotiations.

Assessment and Future

It took a just a single week to terminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the remaining European nations, along with soothing efforts of representatives, and finally, recent disclosures, all served their function.

While new proposals based on previous concepts are approaching, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to resist political attacks from Washington that are founded on Moscow's terms and reflect specific hesitation to alter the situation, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the coming months, mainly require continued Western support.
